Terms of access

Terms of Use

These terms govern your use of this website and its release-update service.

Last updated July 19, 2026

1. Acceptance of these terms

By accessing or using the website for The Eyes We Kept (the “Site”), you agree to these Terms of Use. If you do not agree, do not use the Site. The Site is operated by author Scott Davignon (“we,” “us,” or “our”).

2. Purpose of the Site

The Site provides information, promotional material, excerpts, and release news relating to The Eyes We Kept and the author's work. Content may evolve before publication and does not constitute a promise that a particular edition, feature, release date, or product will be offered.

3. Intellectual property

The Site and its original text, story elements, artwork, graphics, branding, design, and other content are owned by Scott Davignon or used with permission and are protected by copyright, trademark, and other laws. No ownership rights are transferred to you.

You may view the Site and share links to its public pages for personal, noncommercial purposes. You may not reproduce, republish, sell, adapt, scrape, remove attribution from, or use Site content to train a model or build a dataset without prior written permission, except where the law expressly permits that use.

4. Acceptable use

You agree not to:

  • use the Site for unlawful, deceptive, or abusive activity;
  • interfere with the Site's operation, security, or access controls;
  • attempt unauthorized access to systems, accounts, or data;
  • introduce malicious code or overwhelm the Site with automated traffic; or
  • impersonate another person or submit an email address you do not control.

5. Release updates

If you join the release list, you agree to receive the messages you requested, including confirmation and release-related emails. You may unsubscribe at any time using the link included in an email. Delivery is not guaranteed, and we may suspend or discontinue the list or remove addresses associated with abuse, invalid submissions, or delivery failures.

6. Third-party services and links

The Site may link to websites or use services operated by third parties. We do not control and are not responsible for their content, availability, security, or privacy practices. A link does not necessarily imply endorsement. Your use of a third-party service is governed by that provider's terms.

7. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of any kind, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, noninfringement, and freedom from harmful components. We do not guarantee that the Site will be uninterrupted, error-free, or permanently available.

8. Limitation of liability

To the fullest extent permitted by law, Scott Davignon and the Site's service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, or profits, arising from or related to your use of or inability to use the Site. Some jurisdictions do not allow certain limitations, so these limitations apply only to the extent permitted by law.

9. Changes and termination

We may modify the Site or these terms, or suspend access, at any time. Updated terms take effect when posted with a revised “Last updated” date. Continued use after an update means you accept the revised terms.

10. Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction in Colorado, unless applicable law requires otherwise.

11. Severability and entire agreement

If any provision is found unenforceable, the remaining provisions will remain in effect. These terms and the Privacy Policy are the entire agreement regarding use of the Site and replace prior statements about that subject.

12. Contact

For questions about these terms or permission to use Site content, contact Scott Davignon through ScottDavignon.com.
